Terms and Conditions

ClearCasa Free Service Terms of Use

Terms for free accounts and free tools

Version 1.1 | Effective date 24 September 2026

These Terms govern free ClearCasa accounts and the free tools made available through the ClearCasa website and buyer hub. No payment is required for the Free Service. By accepting these Terms and creating an account, you enter into an agreement with ClearCasa for use of the Free Service.

1. Who we are and how to contact us

ClearCasa is operated by Ryan Menzies, with NIF or VAT number ESY3984345T and business address at Algorfa, Costa Blanca (ClearCasa, we, us or our). Contact us about the Service or a complaint at hola@clearcasa.es. Legal notices may be sent to legal@clearcasa.es.

2. Agreement and eligibility

You must be at least 18 and legally capable of entering into a contract to create an account. If you use the Free Service for or with another person, you confirm that you are authorised to provide any information relating to them. Mandatory consumer rights remain unaffected.

The version of these Terms presented when you create your account forms part of our agreement. We will make the Terms available in a form you can save. Our Privacy Statement and Cookie Policy explain how personal data and cookies are handled; they do not replace these Terms. We may send service notices to the email address associated with your account or through the Buyer Hub, subject to applicable legal requirements.

3. The Free Service

ClearCasa provides general educational guidance and organisational tools for people considering a property purchase in Spain. The Free Service may include Getting Ready and Property Search stages, purchase-cost calculators, area information, property shortlists, listing-review tools and access to the Rigby guidance assistant. Available features and limits are those shown on the relevant registration or access page and may change under section 14.

The Free Service supports your understanding and organisation. It does not manage, supervise, approve or complete a property transaction. Buyer Plus, paid access and any later paid product are not included in these Terms. If paid access becomes available, its price, scope and additional terms will be shown before any payment or commitment.

4. Important scope limits

ClearCasa is not a law firm, conveyancer, tax adviser, financial adviser, mortgage adviser or broker, lender, estate agent, property finder, surveyor, valuer, architect, engineer, notary, gestor, insurer, payment provider, escrow service or fraud-prevention service. ClearCasa does not act for you or for any seller, agent, lender or professional involved in a transaction.

Nothing in the Free Service is legal, tax, financial, mortgage, investment, valuation, surveying, structural, planning, insurance or other regulated professional advice. It is not a substitute for advice based on your documents, property, finances, objectives and circumstances.

ClearCasa does not:

  • verify title, ownership, charges, planning status, licences, boundaries, debts, taxes, community matters, physical condition or legal compliance;
  • review or approve contracts, reservation documents, deposit arrangements, mortgage offers, valuations, bank details, invoices or payment instructions;
  • confirm that a document, listing or statement is complete, authentic, current, enforceable or suitable for you;
  • decide whether you should make an offer, reserve, sign, pay, borrow, complete, withdraw or pursue a refund;
  • monitor every deadline, communication, legal change or event affecting your purchase; or
  • guarantee that a purchase will proceed, money will be recoverable, every risk will be identified or any particular outcome will be achieved.

Before you sign, pay or rely on information, obtain property-specific confirmation from the relevant independent, qualified professional. If a point could affect your money, rights, obligations, financing, ownership or ability to use the property, do not rely on ClearCasa alone.

5. Information and completeness

We use reasonable care when preparing and maintaining ClearCasa content. Property processes, professional practices, costs, taxes, lending criteria and legal requirements vary by location, transaction, buyer and time. The Free Service describes selected matters and typical pathways and is not an exhaustive statement of everything that may matter.

Information may become inaccurate, incomplete or out of date. A topic’s absence, a stage marked complete, an automated response or the lack of a warning does not mean that no issue exists, that all necessary checks have been completed or that it is safe to proceed. Where we identify a material error, we may correct it and, where appropriate and reasonably practicable, notify affected users.

6. Your information and responsibilities

You are responsible for entering accurate, complete and current information, checking your entries and updating them when circumstances change. The Free Service can only reflect information made available to it.

You remain responsible for your decisions, instructions, appointments, documents, deadlines, professional appointments, contractual commitments and payments. Read original documents and communications and confirm material matters directly with the relevant professional, authority, lender, seller, agent or payment recipient.

7. Rigby and automated guidance

Rigby provides automated general guidance and may review property-listing information that you submit. Rigby may use information from your buyer profile only when you choose to provide it or expressly permit Rigby to use it. Rigby does not access documents stored elsewhere in your ClearCasa account unless the Service clearly tells you otherwise and you choose to provide the document.

Rigby’s responses may be incomplete, incorrect, outdated, misunderstood or unsuitable for your circumstances. A confident or personalised-sounding response is not professional advice, approval or confirmation. Do not use Rigby as the sole basis for a legal, financial or property decision. Check important outputs against original sources and with the relevant qualified professional before acting.

8. Calculators and estimates

Calculators, budgets, tax illustrations, timelines and other figures are indicative estimates based on stated assumptions and information entered. They may exclude transaction-specific charges, local variations, professional fees, lender conditions, exchange-rate movements, tax changes or later costs. They are not quotations, valuations, tax calculations or promises of what you will pay, receive or borrow. Confirm figures before committing funds.

9. Area information and third parties

Area Finder is currently in beta. Its area profiles were prepared with AI assistance and are being reviewed and refined by ClearCasa. Some information may be incorrect, incomplete or outdated. Use Area Finder as a starting point and verify important details through official sources, local enquiries or relevant professionals before making a property decision.

The Free Service may refer to professionals, authorities, lenders, agents, developers, websites or third-party services. Unless expressly stated, a reference is not an endorsement, appointment, guarantee or representation that a third party is suitable. Third parties act independently and their own terms and privacy practices apply. We do not control the content or operation of websites linked from ClearCasa; check information that matters to you with the relevant source. ClearCasa is independent from property sales and professional referrals and does not receive property sales commissions, professional referral fees or success-based payments.

10. Accounts and verification

Your account is personal and may not be sold, transferred or shared. You must provide accurate registration information, keep your contact details current and be authorised to use any email address or telephone number supplied. You must not create or use additional accounts to evade access limits, restrictions or suspension.

Keep your credentials and verification codes confidential and tell us promptly at hola@clearcasa.es if you suspect unauthorised access. Verification of an email address or telephone number confirms access to that contact method at the time of verification; it does not by itself verify legal identity.

As described in our Privacy Notice, we may process proportionate account identifiers, verification events, access records and device or security information to operate and protect the Free Service, prevent and investigate misuse, enforce these Terms and establish, exercise or defend legal claims.

11. Acceptable use

You must not:

  • use the Free Service unlawfully, fraudulently or in a way that infringes another person’s rights;
  • interfere with the Service, introduce malicious code, test vulnerabilities without permission or attempt unauthorised access;
  • scrape, harvest, systematically extract or use automated means to copy ClearCasa content or data without written permission;
  • use information obtained through the Free Service for unsolicited direct marketing;
  • resell access or use the Free Service or its content to provide a commercial or professional service to others without written permission;
  • use ClearCasa content to build a competing product, dataset, knowledge base or artificial-intelligence training collection; or
  • misrepresent your relationship with ClearCasa or suggest that ClearCasa has approved advice, services, professionals or properties when it has not.

12. Intellectual property and permitted personal use

ClearCasa and its licensors own the Service, branding, software and original content, including the original selection and arrangement of content. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable right to use the Free Service for your own property-purchase planning.

You may save, print or capture reasonable extracts for your own purchase planning. You may share a reasonable extract privately with your co-buyer or appointed professional adviser where genuinely necessary for that purchase, without sharing your login. Except where applicable law permits otherwise, you may not publish ClearCasa content online, distribute it to the public or other third parties, reproduce substantial parts, sell or license it, or use it for a competing or commercial service.

13. Material you provide

You must have the right to submit any listing, text, image or other material you provide. You grant us a limited, non-exclusive right to host, process, reproduce and display that material only as reasonably necessary to provide, secure and support the Free Service, in accordance with these Terms and our Privacy Notice.

Do not provide unnecessary special-category, criminal-offence or third-party personal data. Keep your own copies of anything important; the Free Service is not a permanent archive or substitute for your own records.

14. Availability and changes to the Free Service

We aim to keep the Free Service available but do not promise uninterrupted or error-free access. Maintenance, security events, third-party failures and circumstances beyond our reasonable control may cause interruption.

Because the Service is free, we may add, remove, restrict or discontinue free features and impose reasonable usage limits. Where reasonably practicable, we will give notice of a material reduction or discontinuation and allow a reasonable opportunity to retrieve user-entered information. This section does not remove any mandatory right or remedy.

15. Suspension and ending access

You may stop using the Free Service and request account closure at any time. We may temporarily restrict access while investigating reasonably suspected misuse, unauthorised sharing, unlawful activity, security risk or infringement of rights. We may suspend or terminate access for a serious or repeated breach of these Terms or where reasonably necessary to protect users or the Service. Where appropriate, we will explain the reason and provide an opportunity to respond or remedy the breach.

When access ends, account content may become unavailable after any legally required retention, retrieval or deletion period. Save or export records you need for your purchase. Ending access does not remove rights or liabilities already accrued.

16. Privacy and security

Our Privacy Statement explains what personal data we process, why we process it, how long it is kept, who receives it and how to exercise your rights. Our Cookie Policy explains our use of cookies and similar technologies. We use measures designed to protect the Service, but no online service or transmission can be guaranteed completely secure.

Any optional marketing permission is separate from accepting these Terms. Where a feature asks for separate permission to use information, such as permission for Rigby to use a buyer profile, that choice is also separate and can be managed as explained at the point of collection and in the Privacy Notice.

17. Our responsibility

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer remedies, liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability applicable law requires us to bear.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss caused by matters outside our reasonable control, by a third party for whom we are not legally responsible, or by your failure to provide accurate information, follow a clear warning, secure your account, verify a payment or obtain property-specific professional confirmation, except to the extent our own breach also caused the loss.

The Free Service is supplied for personal use. We are not responsible for business losses where it is used for a trade, business, craft or profession. These Terms do not reduce any statutory right or remedy relating to a digital service supplied to a consumer.

18. Corrections support and complaints

Tell us promptly at hola@clearcasa.es if you believe content is inaccurate, a feature is defective or the Free Service does not operate as described. Include enough detail for us to investigate, but do not send unnecessary sensitive information. We will handle complaints in accordance with applicable law.

19. Changes to these Terms

We may update these Terms where reasonably necessary because of changes to law, security, technology or the Free Service. The current version and effective date will be shown. Where a change materially affects an existing free account, we will provide reasonable notice where practicable. Changes do not retrospectively remove accrued rights. If you do not agree to updated Terms, you may stop using the Free Service and close your account.

20. Governing law and disputes

These Terms are governed by the laws of Spain, subject to any mandatory protection provided by the law of the country in which a consumer habitually resides. A consumer may bring proceedings in any court available under mandatory consumer law and is not required to waive a legally protected forum.

21. General

If a provision is held unlawful or unenforceable, it will be treated as modified or removed only to the minimum extent necessary and the remainder will continue. A delay in enforcing a right is not a waiver. We may transfer our rights or obligations only as permitted by law and without reducing consumer protections.

These Terms and any terms expressly incorporated into them form the agreement for the Free Service. This does not exclude statements or pre-contract information that applicable law makes binding and does not exclude liability for misrepresentation.
